These terms and conditions apply to the zChess app (hereby referred to as “Application”) for mobile devices that was created by Ben Zobrist (hereby referred to as “Service Provider”) as a Free service.
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Application is not intended for children under the age of 13. By using the Application, you confirm that you are at least 13 years old or have obtained parental consent.
What information does the Application obtain and how is it used?
The Application stores and processes your course progress data in iCloud to enable synchronization across your devices. No personally identifiable information, such as your name, email, or payment information, is collected or accessed by the Service Provider. Some functionality, such as syncing course progress across devices, is enabled via iCloud. The Service Provider does not access or share this data.
Responsibility for Your Device and Usage
It is your responsibility to maintain the security of your device and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, or compromise your phone’s security features, and may result in the Application not functioning correctly or at all.
Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of Wi-Fi or if your data allowance is exhausted. If you use the Application outside of a Wi-Fi area, your mobile network provider’s agreement terms still apply, and you may incur charges. By using the Application, you accept responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory without disabling data roaming. If you are not the bill payer for the device, you assume you have obtained permission from the bill payer.
It is also your responsibility to ensure your device remains charged. The Service Provider cannot be held responsible if your device runs out of battery and you are unable to access the Application.
While the Service Provider strives to ensure that the Application is updated and accurate, some functionality relies on third-party services. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality.
Updates and Termination
The Service Provider may provide updates to the Application. Continued use of the Application may require downloading updates. You are encouraged to keep the Application updated for the best experience. The Service Provider may also cease providing the Application and may terminate its use at any time without prior notice. Upon termination:
- (a) the rights and licenses granted to you in these terms will end;
- (b) you must cease using the Application and, if necessary, delete it from your device.
Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- your access to or use of the Application;
- your reliance on the Application; or
- any content obtained through third-party services used by the Application.
Governing Law
These Terms are governed by the laws of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in New York, United States.
Changes to These Terms and Conditions
The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes. The Service Provider will notify you of any updates by posting the new Terms and Conditions on this page.
